Injuries From Walkway Defects
You can sue the City of New York for a street or sidewalk injury caused by defects or obstructions, but there is a short window to bring a claim.
Under a new state law, you can also bring claims against a homeowner or business for walkway hazards. (In some cases, you might have a claim against both the city and an adjacent owner.)
Time is important. We need to investigate quickly to preserve evidence, and there is a 90-day deadline from the date of the accident to serve a Notice of Claim against the city. Contact us immediately if you suffered a trip and fall or slip and fall accident.

- Snow and ice
— We successfully sued Time Warner under the new law when a cable stretched across a sidewalk caused a bad falling injury to our client.
— We settled with the City of New York on behalf of a client whose wheelchair got stuck in sidewalk grooves, pitching her face first onto the pavement.

About Snow and Ice Claims
Property owners have no duty to shovel. If you suffered a sidewalk injury slipping on a natural accumulation, you might not be able to bring a claim. However, if the city, business or homeowner did clear the walk, they can be liable for any hazards created by inadequate snow removal. You can also sue for an unnatural accumulation such as a fire hydrant leak that freezes into black ice.
